{"id":17973,"date":"2025-01-15T23:53:20","date_gmt":"2025-01-15T23:53:20","guid":{"rendered":"https:\/\/pro-truckdrivers.com\/blog\/lawsuit-against-fhp-trooper-who-died-in-crash-that-also-killed-trucker-has-gone-too-far-family-says\/"},"modified":"2025-01-15T23:53:20","modified_gmt":"2025-01-15T23:53:20","slug":"lawsuit-against-fhp-trooper-who-died-in-crash-that-also-killed-trucker-has-gone-too-far-family-says","status":"publish","type":"post","link":"https:\/\/pro-truckdrivers.com\/blog\/lawsuit-against-fhp-trooper-who-died-in-crash-that-also-killed-trucker-has-gone-too-far-family-says\/","title":{"rendered":"Lawsuit against FHP trooper who died in crash that also killed trucker has \u201cgone too far,\u201d family says"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>The father of the Florida Highway Patrol trooper killed in a head-on crash with a semi truck during an unrelated high speed chase is pushing back on a lawsuit filed by the deceased trucker\u2019s family.\u00a0<\/p>\n<p>The <a href=\"https:\/\/cdllife.com\/2025\/family-sues-florida-highway-patrol-and-trooper-after-trucker-was-killed-in-crash-during-police-chase\/\">lawsuit was filed<\/a> by the family of trucker Arsenio Mas just after Christmas 2024, claiming that if FHP Trooper Zachary Fink had halted the chase, both of the men would still be alive instead of perishing in the <a href=\"https:\/\/cdllife.com\/2024\/florida-trooper-and-trucker-dead-in-i-95-police-pursuit-for-kia-driver\/\" target=\"_blank\" rel=\"noreferrer noopener\">February 2nd, 2024 wreck<\/a> in St. Lucie County, Florida.\u00a0<\/p>\n<p>According to <a href=\"https:\/\/www.wptv.com\/wptv-investigates\/trooper-zachary-finks-father-fights-back-against-degrading-lawsuit-following-fatal-crash\" target=\"_blank\" rel=\"noreferrer noopener\">WPTV 5<\/a>, the wrongful death lawsuit filed by the Mas family claims that if not for \u201cFink\u2019s reckless and\/or negligent actions, including driving at an extremely high rate of speed and cutting across all southbound lanes of traffic in hot pursuit of another vehicle, plaintiff Arsenio Mas would not have died.\u201d<\/p>\n<p>\u201cOur client was just driving in his lane of traffic and doing nothing wrong,\u201d Mas family attorney Carlos Silva said. The Mas family alleges that Fink v \u201cdisregarded all policies and procedures of the FHP\u201d regarding high-speed chases, and should have let the suspect go instead of endangering other drivers.\u00a0<\/p>\n<p>\u201cHe violated unfortunately protocol,\u201d Silva said. \u201cWe feel bad for him and his family, but we have to take care of our own and what happened here is horrific.\u201d<\/p>\n<p>\u201cI find everything wrong with this lawsuit,\u201d argues Jason Weisser, Attorney for the Fink estate. Weisser argues that Mas disregarded the rules of the road by continuing to drive as if a police vehicle was not pursuing a suspect at a high speed nearby.\u00a0<\/p>\n<p>\u201cDoes he [Mas} stop? No,\u201d Weisser said. \u201cDoes he even slow down?
